Terms & Conditions / User Agreement
This is a contract between you and Digital Census Service.
By purchasing census record DVDs or downloads from Digital Census Service,
here-in-after referred to as DCS. You are agreeing to be legally bound by
the terms of this contract as set forth below.
Census record DVDs and digital downloads purchased from DCS may not be
rented, sold or given away to others; unless you transfer them in their
entirety to the party purchasing or receiving the census records from
you. You agree to bind those to whom you transfer the census records to
the same terms and conditions of use listed here.
As the original purchaser you are legally responsible and liable
for any violations of this agreement by those to whom you transfer
or sell the census records. If you do not agree with these conditions,
your only recourse is to destroy the census record DVDs or downloads.
Professional Researchers
Purchase and use of our census record DVDs and downloads by professional
researchers is permitted as long as they are transferred to the party
paying for the research.
Professional researchers agree not to keep any copies of the DVDs or
downloads; unless they are being purchased for their own personal use.
Professional researchers agree that they will notify and bind their
customer to the terms listed in this contract, before transferring the
DVDs or downloads to them. To make the transfer or sale of the census
records easier, here is an online form you can use.

(GIF) Provide one copy to your
customer and have them sign another for your files.
Failure to do so will make you legally responsible for any violation of
this contract by your customer.
Personal Use
Census record DVDs and downloads purchased from DCS may be used in your
personal and private genealogy but must not be copied or provided to others
without the expressed written consent of DCS.
The lone exception is when you are transferring all copies of the DVD or
download to another party. However, before transferring a DVD or download
to another party, you agree that you will notify and bind them to the terms
listed in this contract. To make the transfer or sale of the census
records easier, here is an online form you can use.

(GIF) Provide one copy to the
person you are transferring the records to and have them sign another for
your files.
Failure to do so will make you legally responsible if they violate this contract.
Use on Websites and in Books
Up to 5 images from each census DVD or download you purchase may be
posted on a website or included in a book, including ebooks. For example, if
you purchase 6 DVDs or downloads, you are allowed to post up to 5 images from
each for a total of 30 images. The following statement must also be posted
either directly above or below each image:
"Image provided courtesy of DCS
(digitalcensusservice.com)."
Should you wish to use or post more than five images please contact us. We will
consider your request.
Enforcement of this Contract
The terms and conditions as set forth in this agreement will be protected
vigorously by DCS. Violations will be enforced through the U.S. Federal court
system. By purchasing a census record DVD or download, you agree that in the
event of a dispute only the laws and courts applicable to the state of
Washington will govern and resolve said dispute. In case of a judgment against
you, we will ask the court to enforce this contract at law or equity.
You agree that DCS is not responsible for your failure to read the terms of this
agreement and cannot be held financially responsible for your failure to do so.
IMPORTANT NOTICE: Census record DVDs
and downloads purchased from DCS have been tagged with your personal order
number ID.
